1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," "you," or "your") and pksky ("pksky," "we," "us," or "our"), operating the online gaming platform accessible at https://pksky.cam and any associated mobile applications, software, or services (collectively, the "Platform"). These Terms apply to all pksky users throughout the Republic of the Philippines, regardless of province, city, or municipality of residence. By using pksky services, you acknowledge that online gaming involves risk, that outcomes are determined by random chance through certified Random Number Generator technology, and that you may lose money. You agree to participate in gaming activities solely for personal entertainment purposes using disposable income you can afford to lose without financial hardship.

2. Eligibility Requirements

2.4 Single Account Requirement

Each individual is permitted only one (1) pksky account. Multiple accounts registered by the same person, whether using different email addresses, phone numbers, or personal information, are strictly prohibited. We reserve the right to close duplicate accounts, void associated wagers, and confiscate any funds or winnings derived from such accounts without prior notice.

3. Account Registration and Security

Creating a pksky account requires completion of our registration process and compliance with all verification procedures. Account security is a shared responsibility between pksky and the account holder.

3.1 Registration Process

To register a pksky account, you must provide accurate, current, and complete information including but not limited to your full legal name as it appears on government-issued identification, date of birth, residential address within the Philippines, valid Philippine mobile phone number, and email address. All information provided during registration must be truthful and verifiable. You agree to update your account information promptly if any changes occur to ensure accuracy at all times.

3.2 Identity Verification

pksky implements Know Your Customer (KYC) procedures mandated by Philippine law and PAGCOR regulations. You may be required to submit government-issued identification documents (Philippine passport, driver's license, UMID, SSS ID, or other valid ID), proof of address (utility bill, bank statement, or government correspondence dated within the last three months), and selfie photographs for identity verification. Verification may be required before your first withdrawal or at any time during your use of pksky services. Failure to complete verification when requested will result in restricted account functionality including inability to withdraw funds.

3.3 Account Security Responsibilities

You are solely responsible for maintaining the confidentiality of your pksky account login credentials, including your username and password. You must not share your account information with any third party or allow others to access your account under any circumstances. All activities conducted through your account are your responsibility, including any deposits, wagers, or withdrawals made by third parties who gain access to your credentials through your negligence or intentional disclosure.

You agree to immediately notify pksky customer support if you become aware of any unauthorized access to your account, suspect your password has been compromised, or notice any suspicious activity. We recommend using strong, unique passwords and enabling two-factor authentication when available to enhance account security.

3.4 Account Limitations

pksky reserves the right to refuse account registration, temporarily suspend accounts, or permanently close accounts at our sole discretion for any reason including but not limited to failure to meet eligibility requirements, provision of false information, suspected fraudulent activity, violation of these Terms, or requests from regulatory authorities. We may impose betting limits, deposit limits, or other restrictions on any account based on our risk management policies or responsible gaming considerations.

4. Deposits and Payment Methods

pksky facilitates deposits through various payment methods popular among Filipino players, including e-wallets, online banking, and over-the-counter payment channels. All financial transactions are processed securely using industry-standard encryption technology.

4.1 Accepted Payment Methods

pksky currently accepts deposits via GCash, PayMaya (formerly PayMaya), bank transfers from major Philippine banks (BPI, BDO, Metrobank, UnionBank, Security Bank, and others), online banking portals, and over-the-counter payments at authorized retail locations. Available payment methods may vary based on your location and account status. Minimum and maximum deposit amounts apply to each payment method and are displayed during the deposit process.

4.2 Deposit Processing

Most electronic deposits (GCash, PayMaya, online banking) are processed instantly and appear in your pksky account balance within seconds of confirmation. Bank transfers may require one to four hours for processing depending on the sending institution. Over-the-counter payments typically process within 15 minutes to two hours after payment verification. pksky does not charge fees for deposits, though your payment provider or bank may impose their own charges, which are your responsibility.

4.3 Source of Funds

All deposits must originate from payment accounts registered in your own legal name. Third-party deposits, including deposits from family members, friends, or business associates, are strictly prohibited. You represent and warrant that all funds deposited to your pksky account are obtained legally, do not derive from criminal activity, and are not subject to any restrictions or claims by third parties. We reserve the right to investigate the source of funds and request supporting documentation for any deposits that raise concerns.

4.4 Currency

All pksky transactions are conducted in Philippine Pesos (PHP). If you deposit funds using a payment method denominated in another currency, your payment provider will convert the amount to PHP using their exchange rate, and the converted amount will be credited to your account. pksky is not responsible for currency conversion rates or associated fees imposed by payment providers.

5. Withdrawal Terms and Conditions

Withdrawals from your pksky account are subject to identity verification, compliance with these Terms, and satisfaction of any applicable wagering requirements on bonuses received.

5.1 Withdrawal Methods

Withdrawals are processed to the same payment method used for deposit whenever possible. GCash and PayMaya withdrawals typically process within 15 to 30 minutes during business hours. Bank transfers process within one to three hours for major Philippine banks. You may only withdraw funds to payment accounts registered in your own legal name, and third-party withdrawals are prohibited.

5.2 Withdrawal Requirements

Before your first withdrawal, you must complete identity verification by submitting required documentation as described in Section 3.2. Your account must have a positive balance after all pending wagers are settled. If you have received any bonuses or promotional offers, associated wagering requirements must be satisfied before bonus-related funds become eligible for withdrawal. Minimum withdrawal amounts apply and vary by payment method.

5.3 Withdrawal Limits

Daily, weekly, and monthly withdrawal limits apply to all accounts. Specific limits are displayed in your account settings and may vary based on your account status, verification level, and gaming history. VIP members may qualify for higher withdrawal limits. We reserve the right to process large withdrawals in installments or request additional verification for withdrawals exceeding certain thresholds.

5.4 Withdrawal Fees

pksky does not charge fees for most withdrawals. However, excessive withdrawal requests (more than three per day) may incur processing fees. Your payment provider or bank may impose their own fees for receiving transfers, which are your responsibility. Withdrawal fees, if applicable, are clearly disclosed before you confirm the withdrawal request.

5.5 Withdrawal Cancellation

We reserve the right to cancel or delay withdrawals if we suspect fraudulent activity, money laundering, violation of these Terms, or other irregularities. Withdrawals may be suspended pending investigation of suspicious betting patterns, bonus abuse, or other prohibited activities. If a withdrawal is cancelled, funds will be returned to your account balance, and you will be notified of the reason for cancellation.

6. Bonuses, Promotions, and Loyalty Programs

pksky offers various bonuses, promotions, and loyalty rewards to enhance your gaming experience. All promotional offers are subject to specific terms and conditions in addition to these general Terms.

6.1 Bonus Eligibility

Bonuses and promotions are available to eligible pksky members at our discretion. We reserve the right to exclude certain players from promotional offers based on risk assessment, past bonus abuse, or other factors. 6.2 Wagering Requirements

Most bonuses are subject to wagering requirements before bonus funds and associated winnings can be withdrawn. Wagering requirements specify the amount you must wager (expressed as a multiple of the bonus amount) before bonus funds become withdrawable. For example, a bonus with 30x wagering requirement requires you to wager 30 times the bonus amount. Different games contribute differently toward wagering requirements: slots typically contribute 100%, table games may contribute 10-20%, and some games may be excluded entirely. 6.3 Bonus Restrictions

We monitor gaming patterns and reserve the right to void bonuses, confiscate winnings, and close accounts engaged in bonus abuse without prior warning. 6.5 Loyalty Program

The pksky Loyalty Program rewards regular players with points based on wagering activity. Points can be redeemed for cashback, free spins, tournament entries, and other benefits. Loyalty program terms are subject to change, and we reserve the right to modify point earning rates, redemption values, or program structure at any time. Loyalty points have no cash value and cannot be transferred to other players or sold.

7. Gameplay Rules and Game Integrity

All games available on the pksky Platform are provided by licensed third-party gaming software suppliers and operate using certified Random Number Generator (RNG) technology to ensure fair and random outcomes.

7.1 Game Outcomes

All game results are determined by RNG technology independently certified by recognized international testing laboratories. pksky does not manipulate game outcomes, adjust payout percentages based on player activity, or interfere with the randomness of results. Each game spin, card deal, or other outcome is independent of previous results and statistically random within the game's mathematical model.

7.2 Game Rules

Each game available on the Platform has specific rules governing gameplay, betting options, payouts, and special features. You are responsible for understanding the rules of any game before wagering real money. Game rules are accessible through information buttons within each game interface. In the event of any discrepancy between game rules and these Terms, these Terms take precedence for matters not specifically covered by game rules.

7.3 Game Malfunctions

In the rare event of a game malfunction, software error, or technical issue that affects game outcomes or payouts, all affected wagers and payouts are void. pksky and our game providers are not liable for losses resulting from technical malfunctions. If a malfunction is discovered after payouts have been processed, we reserve the right to correct the error by adjusting account balances. 7.4 Disconnections

If your connection to the Platform is interrupted during gameplay, any wagers already placed will continue and settle according to the game outcome. For live dealer games, if you are disconnected during an active hand or round, standard house rules apply. You may reconnect and review game history to see outcomes of any wagers placed before disconnection. pksky is not responsible for losses resulting from internet connection issues, device failures, or other technical problems on your end.

7.5 Betting Limits

Each game has minimum and maximum betting limits displayed in the game interface. We reserve the right to impose player-specific betting limits or restrict access to certain games based on our risk management policies. 8. Prohibited Activities and Conduct

The following activities are strictly prohibited and constitute material breaches of these Terms, subject to immediate account closure and forfeiture of funds:

• Exploiting software errors, bugs, or loopholes for financial gain
• Reverse engineering, decompiling, or attempting to access pksky source code or proprietary systems
• Sharing account information or allowing third parties to use your account

8.3 Abusive Behavior

• Harassment, threats, or abusive language toward pksky staff, customer support agents, live dealers, or other players
• Publishing defamatory, false, or misleading statements about pksky on social media or review platforms
• Attempting to damage pksky reputation through coordinated negative campaigns
• Filing fraudulent chargebacks or payment disputes after receiving goods or services

8.4 Legal Violations

• Accessing pksky services from jurisdictions where online gaming is prohibited
• Using VPNs, proxies, or other tools to circumvent geographic restrictions
• Violating any applicable local, national, or international laws while using the Platform
• Attempting to bypass age verification or allowing minors to access your account

9. Account Closure and Termination

Either party may terminate your pksky account in accordance with the provisions of this section.

9.1 Voluntary Closure

You may voluntarily close your pksky account at any time by contacting customer support and requesting account closure. Before closing your account, you must withdraw all available funds (subject to meeting withdrawal requirements). Once an account is closed at your request, any remaining bonus funds will be forfeited. Account closure is typically processed within 24 hours of your request. You may request permanent self-exclusion if you have gambling concerns, which prevents you from reopening your account or creating new accounts in the future.

9.2 pksky-Initiated Termination

pksky reserves the right to suspend or permanently close your account immediately and without prior notice if we determine, at our sole discretion, that you have violated these Terms, engaged in prohibited activities, or pose a risk to the integrity of our gaming operations. Reasons for pksky-initiated termination include but are not limited to:

• Breach of any provision of these Terms
• Fraudulent activity, bonus abuse, or attempts to exploit the Platform
• Failure to complete identity verification when requested
• Chargeback or payment dispute filing after receiving services
• Abusive behavior toward staff or other players
• Requests from regulatory authorities or law enforcement agencies
• Inactive accounts (no login or gaming activity for more than 12 consecutive months)

9.3 Effects of Termination

Upon account termination, all gambling activities must immediately cease. If your account is closed for violation of these Terms, we reserve the right to confiscate all funds including deposits, winnings, and bonuses. If your account is closed without breach of Terms, you will be permitted to withdraw any legitimate balance remaining after settling pending wagers and deducting any bonus funds. Loyalty points and promotional offers are forfeited upon account closure. You remain liable for any obligations or liabilities incurred before account termination.

9.4 Reopening Closed Accounts

Accounts closed for Terms violations cannot be reopened under any circumstances. Accounts closed voluntarily may be reopened by contacting customer support, subject to our approval. Accounts subject to responsible gaming self-exclusion cannot be reopened during the exclusion period and may require additional verification before reopening after the exclusion period expires.

10. Limitation of Liability and Disclaimers

10.1 Service Availability

pksky strives to provide continuous service availability but does not guarantee uninterrupted or error-free operation. The Platform may be unavailable due to maintenance, technical issues, regulatory requirements, or circumstances beyond our control. We are not liable for any losses, missed opportunities, or damages resulting from Platform unavailability or service interruptions.

10.2 Disclaimer of Warranties

The pksky Platform and all associated services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will meet your requirements, operate without interruption, or be free from errors or viruses.

10.3 Gaming Risks

You acknowledge and accept that online gaming involves financial risk and that you may lose money. Past gaming results do not predict future outcomes. We do not guarantee that you will win any particular amount or that you will win at all. Decisions to wager money are your sole responsibility, and we are not liable for gambling losses regardless of amount.

10.4 Third-Party Providers

Games on the pksky Platform are provided by third-party software suppliers. We are not liable for any errors, malfunctions, or issues arising from third-party game software. Game providers are responsible for the accuracy, fairness, and functionality of their games. Any disputes regarding game functionality should be directed to customer support for investigation with the applicable game provider.

10.5 Maximum Liability

To the maximum extent permitted by law, pksky's total liability to you for any claims arising from your use of our services shall not exceed the amount of funds you deposited to your account in the six (6) months preceding the event giving rise to the claim. In no event shall pksky be liable for indirect, incidental, consequential, special, or punitive damages including but not limited to lost profits, lost opportunities, or emotional distress.

10.6 Indemnification

You agree to indemnify, defend, and hold harmless pksky, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Platform, your violation of any third-party rights, or your violation of applicable laws.

11. Dispute Resolution and Governing Law

These Terms and any disputes arising from your use of pksky services are governed by the laws of the Republic of the Philippines and PAGCOR regulations.

11.1 Complaints Procedure

If you have any complaint or dispute regarding pksky services, you must first contact our customer support team through live chat, email, or phone. We will investigate your complaint and attempt to resolve the issue within a reasonable timeframe, typically within 5-10 business days depending on complexity. Provide as much detail as possible including dates, transaction references, and relevant screenshots to facilitate investigation.

11.2 Escalation

If you are unsatisfied with our initial response, you may escalate your complaint to our management team through customer support. Management will review the case and provide a final decision within 14 business days. If you remain unsatisfied after exhausting our internal complaints procedure, you may file a complaint with PAGCOR as our licensing authority.

11.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. You consent to the exclusive jurisdiction of Philippine courts for resolution of any disputes that cannot be resolved through our complaints procedure or arbitration.

11.4 Arbitration

For disputes exceeding ₱50,000, pksky may elect to submit the dispute to binding arbitration under Philippine arbitration law rather than litigation. Arbitration shall be conducted in English in Metro Manila by a single arbitrator appointed by mutual agreement. The arbitrator's decision shall be final and binding, with limited grounds for appeal.

11.5 Class Action Waiver

You agree that any dispute resolution proceedings shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in class action lawsuits or class-wide arbitration against pksky.

12. Changes to Terms and Conditions

pksky reserves the right to modify, amend, or update these Terms at any time at our sole discretion. Changes may be necessary to comply with regulatory requirements, reflect new services or features, address security concerns, or clarify existing provisions.

12.1 Notification of Changes

Material changes to these Terms will be communicated to you through email notification to your registered email address, prominent notice on the Platform homepage, or in-account messaging. Minor clarifications or non-material changes may be implemented without individual notification, though the "Last Updated" date at the beginning of these Terms will reflect the revision date.

12.2 Acceptance of Changes

Your continued use of pksky services after changes take effect constitutes acceptance of the modified Terms. If you do not agree with revised Terms, your sole remedy is to close your account and discontinue using pksky services. You should review these Terms periodically to stay informed of any updates.

12.3 Version Control

Previous versions of these Terms are archived and available upon request through customer support. In the event of any dispute regarding Terms interpretation, the version in effect at the time the relevant events occurred shall govern.
